Probably has nothing to do with his feelings about the upcoming fight and more to do with traveling and being ignorant of the different laws in each states regarding possession of firearms. Some states, like Nevada and many Southern States have lenient laws regarding possession others like New York and California, have very strict laws. That is the dumb thing about this situation. Guerrero, as a firearm owner, should know what the laws are to each state in which he travels. Especially coming from California. It is a bit early to say what the charges are and there is always a great deal of sensationalism and speculation that goes on.

You can possess firearms in your checked luggage, but it is usually a rule/law that you report the firearm to the airline and have it in a locked container separate from any ammunition. It could be as serious as him having the firearm on his person or carry on, or as technical as him not having reported the firearm to the airline, having a non-approved carrying case, or not properly marking the container. Given New York's recent legislation, he may also have taken a firearm that is not legal to possess in New York or a magazine with a capacity more than 7 rounds in the state.

Possession is not as simple as it may seem. In California, I am not allowed to possess a firearm within a certain distance from a school. I live across the street from a school so it presents a problem right? Well, no....I can possess and transport that firearm in an approved, lockable container if I am going to and from a range. If I have ammunition in the same locked container however, then I am guilty of possession of a loaded firearm even if the ammunition is not in the magazine and the magazine is not in the well of the firearm. I learned that the hard way when I first became an owner, (fortunately not the legally hard way) when I took my firearm to the range and was told rather sternly that I was committing a felony by simply possessing ammunition in the same locked container as the firearm, even though the rounds were not in the magazine and the firearm was clear. I now carry the firearm in a separate case and the ammunition in a locked compartment of my range bag.

So...no, it doesn't take a scientist, but it takes a lot of attention to detail, which I am sure Guerrero is not really focusing on given that he is training and attending promotional events all around the country.

UPDATE: He had an unloaded .40 caliber pistol with no ammunition for what his team claims, was a photo opportunity. Still, incredibly stupid given the state in which he was traveling, then again, David Gregory the host of Meet the Press was recently not charged with anything when he illegally possessed a high capacity magazine for an AR-15 in Washington DC, a felony.
